Petitioner instead of taking effective steps for early disposal of the application under Order 39 Rules 1 & 2 of C.P.C., has straightway approached this Court by way of this present CMP. For the Petitioner's not taking steps for issuance of notice in the application under Order 39 Rules 1 & 2 of C.P.C., this Court declines to interfere in the impugned order at this stage. However, considering the request made by the learned counsel for the Petitioner, this Court permits the petitioner to withdraw the CMP.
