This matter is taken up through Hybrid Mode.

Heard Mr. A.K. Biswal, learned counsel for the petitioner and Miss S. Mishra, learned Additional Standing Counsel for the State.

The petitioner being aggrieved by the order dated 18.02.2022 directing for issuance of NBWA by the learned S.D.J.M., Anandapur in 1.C.C. Case No. 271 of 2015, has filed this CRLMC.

It is stated by the learned counsel for the petitioner that, on the date fixed an adjournment was sought by filing a petition inter alia that because of illness the petitioner is not in a position to appear, that the learned Court below mechanically rejected the same and issued the impugned order of NBW.

Considering the submissions made and taking into account the recitals in the time petition at Annexure-2, the order of issuance of NBW dtd. 18.02.2022 is hereby quashed. 6.

The petitioner undertakes to appear on the date fixed without fail.

The CRLMC is disposed of accordingly.

Urgent certified copy of this order be granted as per rule. ( V.Narasingh ) Balaram Judge
