1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 6th November, 2020 in connection with Bangiriposi P.S.
Case No.177/2020 corresponding to S.T. Case No.85/2021 pending in the court of learned 2nd Addl. Sessions Judge, Baripada for the alleged commission of the offence under Sections 498-A/302 of I.P.C..
4. The prosecution allegation is that the Petitioner caused the death of his wife after subjecting him to cruelty. From the statement of witnesses examined during investigation, it
// 2 // transpires that the Petitioner and the deceased had initially a good relationship, but thereafter the Petitioner started abusing her by suspecting her character. There is no material on record to suggest that because of such abuse, the deceased was forced to commit suicide.
5. Having regard to the above facts and taking into consideration the period of his detention in custody as also the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail.
6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted on proper application.
