This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The only grievance of the Petitioner in the present writ petition is that the Opposite Parties-authorities are not considering the case of the Petitioner for regularization of his service although similarly situated employees regularized their services by office of the Engineer-in-Chief, Water Resources, Odisha dated 26.02.2015 and seeking for a direction to consider the representations of the Petitioner under Annexure-7 series.

It is submitted by learned counsel for the Petitioner that other employees, who are similar footing with the present Petitioner, have been regularized and their names reflected in the said letter dated 26.02.2015. He further submits that the Petitioner has been submitted a series of representations dated 25.03.2019 and 25.08.2021 and the Engineer-in-Chief, Water Resources, Odisha has not considered the

// 2 // grievance of the Petitioner as of now. Further, learned counsel for the Petitioner submits that the Petitioner is going to retire from service by end of this month.

Mr. K.K. Nayak, learned counsel for the State submits that he has no objection, if a direction is given to the Opposite Parties to consider the representations of the Petitioner within a stipulated period of time.

Considering the limited nature of grievance as well as considering the fact that the Petitioner is going to retire from service by end of this month, this Court disposes of the writ petition with a direction to the Engineer-in-Chief, Water Resources, OdishaOpposite Party No.2 to consider the representations of the Petitioner dated 25.03.2019 and 25.08.2021 under Annexure-7 series within a period of four weeks from the date of production of certified copy of this order in accordance with law. In the event service of the Petitioner should be regularized immediately before his retirement, all other consequential service benefits shall be given to the Petitioner within a period of eight weeks.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
