Debabrat Nayak v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.568 of 2022 Debabrata Nayak ....
Petitioner Mr. P.K. Chand, Advocate -versusState of Odisha ....
Opposite Party Mr. K. Das, A.S.C.
CORAM:
JUSTICE B. P. ROUTRAY
ORDER
21.03.2022 Order No.
01.
1. Heard Mr. P.K. Chand, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.
2. Admittedly, the Petitioner having not challenged the order of cognizance, no merit seems in his favour in challenging the order of issuance of NBW dated 1.12.2017 and as such, I do not find any merit in the present petition.
3. At this stage, learned counsel for the Petitioner seeks liberty to surrender before the learned S.D.J.M., Balangir and seek for bail. In such event, in case the Petitioner surrenders before the learned S.D.J.M., Balangir within a period of four weeks from today in G.R. Case No.451(A) of 2017 and prays for his release on bail, the same shall be considered by the learned S.D.J.M. in accordance with law including the ground of parity, if any applicable.
4. The CRLMC is disposed of accordingly.
