This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with MV-79 P.S. Case No.9 of 2022 corresponding to G.R. Case No.54 of 2022 pending in the Court of learned S.D.J.M., Motu for alleged commission of offences under sections 294, 366, 376 read with section 34 of the Indian Penal Code. In pursuance of the order dated 29.03.2022, the petitioner has produced the victim girl before the I.O. and her 161 and 164 Cr.P.C. statements have been recorded.
// 2 // Learned counsel for the State has produced the 164 Cr.P.C. statement of the victim which is taken on record.
On perusal of such statement, it appears that the victim has not alleged anything against the petitioner.
Learned counsel for the State submitted that the victim refused for her medical examination.
Considering the submissions made by the learned counsel for both the parties, the nature of accusation against the petitioner and since the victim has given a clean chit to the petitioner, the interim order dated 29.03.2022 is made absolute.
The ABLAPL is accordingly disposed of.
Issue urgent certified copy as per Rules.
