Petitioner is a licensee of Santarapur IMFL OFF Shop through the lottery system for the year 2021-22. 3.

By filing the present writ petition, he has objected to the possible grant of ON Shop license in the vicinity of his shop to Prakash Chandra Sahoo (Opposite Party No.5) on the pretext of granting Hotel and Restaurant for the remaining period of the year 2021-2022, in violation of Rule-59 of the Odisha Excise Rules, 2017.

At the time of hearing, counsel for the Petitioner states that the present writ petition has become infructuous in the view of the fact that the competent authority has rejected the prayer of Opposite Party No.5 for grant of such aforesaid license. P.T.O.
