1. Heard Mr. D.K. Sahoo, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party No.1.

2. The impugned order dated 16.08.2021 of the learned J.M.F.C., Chandiikhole has been challenged wherein NBW was issued against the present Petitioner, namely, Ranjan Kumar@Ranjan Mohapatra.

3. It is submitted on behalf of the Petitioner that the Petitioner was allowed dispension of personal attendance under Section 205 of the Cr.P.C., but due to some mis-communication on the date fixed, the impugned order of NBW was issued against him.

4. After hearing Mr. Das, learned A.S.C. for the State-Opposite Party, the CRLMC is disposed of with a direction to the Petitioner to surrender before the learned J.M.F.C., Chandikhole without further delay. In the event, the Petitioner surrenders on or before

20th April, 2022 and prays for his release on bail, the same shall be considered in accordance with law on the same day. Till 20th April, 2022, the execution of NBW issued against the Petitioner shall be kept in abeyance.

5. An urgent certified copy of this order be granted on proper application.
