Heard Mr. P.K. Panda, learned counsel for the Appellant and Mr. K. Panigrahi, learned counsel appearing for claimant - Respondents.

Present application has been filed seeking condonation of delay of 315 days in preferring the appeal. The grounds mentioned for the same is that the file was misplaced in the office of the conducting counsel. This is not found satisfactory.

The I.A. is dismissed.

Consequently the appeal is dismissed on the ground of limitation.

5.

The statutory deposit made by the appellant before this court along with accrued interest be refunded to the Appellant - insurer on proper application.
