CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
22.3.2022.
Order No.
01.
1. This matter is taken up through virtual mode.
2. Heard Mr. P.K.Nayak, learned counsel for the Petitioner and Mr. A. Pradhan, learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 16th April, 2021 in connection with Turekela P.S. Case No.62/2021 corresponding to G.R. Case No.174/2021 and S.C. No.14/2021 pending in the court of learned Addl. Sessions Judge, Kantabanji for the alleged commission of the offence under Sections 498-A/304B/306 of I.P.C. and Section 4 of the D.P. Act.

4. It is submitted that the allegations against the Petitioner are entirely omnibus in nature and that all other co-accused persons have been released on bail. It is seen that the informant has clearly alleged about the demand for dowry and of treating the deceased with cruelty by the Petitioner, who is the husband, and her in-laws.
5. Considering the nature of accusations and the availability of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is, therefore, rejected.
6. It is also submitted that trial has already commenced in which three witnesses have already been examined. Hence, liberty is granted to the Petitioner to renew his prayer after examination of some more material witnesses in the case. (Sashikanta Mishra) AKB Judge
