This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application for bail under section 439 of Cr.P.C. in connection with Dhenkanal Town P.S. Case No.75 of 2021 corresponding to C.T. (Special)(NDPS) Case No.03 of 2021 pending in the Court of learned Judge, Special Court, Dhenkanal for offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act.

The prayer for bail of the petitioner was rejected by the learned Judge, Special Court, Dhenkanal vide

// 2 // order dated 17.02.2022.

Perused the status report submitted by the learned trial Court from which it appears that the case is now posted to 20.05.2022 for framing of charge. The earlier bail application of the petitioner in BLAPL No. 2334 of 2021 was rejected as per order dated 09.08.2021 and direction was given to the learned trial Court to conclude the trial within a period of six months from the date of framing of charge and the petitioner was given liberty to renew his prayer for bail if the trial is not concluded within the said period. Since the time granted to the learned trial Court to conclude the trial is not yet over, I am not inclined to release the petitioner at this stage. Accordingly, the prayer for bail stands rejected.

BLAPL is accordingly disposed of.
