This matter is taken up through Hybrid Mode.

Heard Mr. P.R. Mishra, learned counsel for the petitioner and Miss S. Mishra, learned Additional Standing Counsel for the State.

The learned counsel for the petitioner is aggrieved by the order dated 22.09.2021 passed in Spl. (POCSO) Case No. 100 of 2019 by the learned Adj-cum-Special Judge, Bhadrak, by which NBWA was issued against the petitioner having not surrendered after being released on bail.

Taking into account the factual matrix of the case at hand, this Court directs that, in the event the petitioner surrenders within a period of three weeks hence and move for bail, the same

shall be considered on its own merits by the learned Court in seisin of the matter.

5.

For a period of three weeks, no coercive action shall be taken against the petitioner.

6.

The CRLMC is disposed of accordingly.

7.

Urgent certified copy of this order be granted as per rule. ( V.Narasingh ) Balaram Judge
