This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application for bail under section 439 of Cr.P.C. in connection with Bhanjanagar P.S. Case No.540 of 2020 corresponding to Spl. G.R. Case No.34 of 2020 pending in the Court of learned Addl. Sessions Judge -cum- Special Judge, Bhanjanagar for offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act.
The prayer for bail of the petitioner was rejected by the learned Special Judge, Bhanjanagar vide order dated 22.10.2020.
// 2 // Perused the order sheet dated 04.05.2022 and 05.05.2022 of the learned trial Court, from which it appears that no prosecution witnesses have been examined on the said dates. The petitioner along with another approached this Court for grant of bail in BLAPL No. 8114 of 2020 and this Court while rejecting the bail application as per order dated 16.03.2021, directed the learned trial Court to conclude the trial within a period of six months from the date of framing of charge. It is stated at the Bar that charge was framed on 19.04.2022 and therefore, the period specified in the said order is not yet over.
In that view of the matter, I am not inclined to grant bail to the petitioner. However, the petitioner is at liberty to renew his prayer for bail as per the order dated 16.03.2021.
The BLAPL is accordingly disposed of.
A copy of the order be communicated to the learned trial Court.
