The Petitioner approached this Court under Section 482 of the Cr.P.C. with a prayer to quash order of cognizance dated 23rd March, 2017 in G.R. Case No.711 of 2016 (arising out of Phulbani Town P.S. Case No.290 of 2016), pending before the learned S.D.J.M., Phulbani for alleged offence under Section 498A/420/423/294/109/406/506/34 of the Indian Penal Code read with Section 4 of the Dowry Prohibition Act.

At the time of hearing, Ms. Anita Sahoo, proxy counsel appearing on behalf of Mr. Anirudha Das, learned counsel for the Petitioner submitted that she has no up-to-date instructions as regards proceeding before the SDJM.

Record reveals that this matter, being kept pending since 2017, has not been proceeded with and defects pointed out by the Registry have also not been removed.

In view of such situation, the CRLMC stands dismissed reserving liberty to the counsel for the Petitioner to revive the same within a period of sixty days, if cause of action still subsists. (M.S. Raman) Judge Laxmikant
