Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 15.11.2021 in connection with Lock P.S. Case No.279 of 2021 corresponding to G.R. Case No.1901 of 2021 pending in the Court of learned J.M.F.C.(P), Kujang for the alleged commission of offence under Section 498A/302/304(B)/34 of IPC. 4.

It is submitted that the allegations against the petitioners are entirely omnibus in nature in particular there are materials on record to show that the petitioners were living separately. However, it is seen from the FIR as well as other documents on record that there is direct allegation against the petitioners regarding demand for dowry not only at the time of marriage but also subsequent thereto.

Having regard to the above factors and the gravity of the offence, I am not inclined to allow the prayer for bail, which is therefore rejected. It is however open to the petitioners to renew their prayer after examination of some material witnesses including the informant.

BLAPL is accordingly rejected.

Issue urgent certified copy as per rules.
