Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.02.2022 in connection with Kosagumuda P.S. Case No.48 of 2021 corresponding to T.R. Case No.22 of 2021 pending in the Court of learned Sessions Judge-cum-Special Judge, Nabarangpur for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of N.D.P.S. Act. 4.
As it appears nothing was seized from the possession of the petitioner. He was implicated on the basis of the statement of the co-accused persons to the effect that they had obtained the contraband from the petitioner and was transporting it for the purpose of being sold to one Rama Chandra Bisoi and Subit Bisoi. It further appears that the said Ram Chandra Bisoi has already been granted bail by this Court as per the order passed by this Court in BLAPL No. 3802 of 2021.

Having regard to the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms
and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
