CRLMC No.585 of 2022 Gaur Barik ....

Petitioner Mr. R.N. Pattnaik, Advocate -versusState of Orissa ....

Opp. Party Ms. S. Mishra, Additional Standing Counsel

CORAM:

SHRI JUSTICE B. P. ROUTRAY

ORDER

27.4.2022 Order No.

02.

1.

Heard Mr. R.N. Pattnaik, learned counsel for the Petitioner and Ms. S. Mishra, learned Additional Standing Counsel for Opposite Party - State.

2.

The impugned order dated 20th July, 2020 of learned S.D.J.M., Bonai in G.R. Case No.496 of 2017 issuing NBW of arrest against the Petitioner is challenged in the present application. 3.

The alleged offences are under Sections 457/395/436/427 of the I.P.C. read with Section 5/6 of the Explosive Substance Act. 4.

Upon hearing both parties and from perusal of record, it reveals that the prayer of anticipatory bail of the present Petitioner was dealt with in ABLAPL No.3663 of 2020 by order dated 1st December, 2020

and the Petitioner had the opportunity to surrender earlier. But he did not avail that benefit.

5.

No ground is seen in the present petition keeping in view seriousness of the allegations against the petitioner and as such, the order of learned S.D.J.M. in issuing NBW of arrest is not found to be interfered with.

6.

The CRLMC is dismissed.
