1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 6th January, 2022 in connection with Baisingha P.S.
Case No.372/2021 corresponding to C.T. Case No.964/2021 pending in the court of learned J.M.F.C., Betnoti for the alleged commission of the offence under Sections 148/395/435/153-A/506/149 of the I.P.C.

As it appears that being aggrieved by the death of a person from Muslim Community a group of persons including the present Petitioner went to the medicine shop of the informant and ransacked it and thereafter took away cash of Rs.30 lakhs and also set fire to the shop. Since the occurrence appears to have taken place at the spur of the moment without a definite intention to cause damage to the informant, I am inclined to allow the prayer for bail.

Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case, failing which appropriate order shall be issued to take him to custody again and he shall appear before the I.I.C. of Baisingha P.S. once every week for a period of six months.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
