This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Excise Mobile Unit-I, Cuttack P.R. No. 116/2021-22 corresponding to 2(a) C.C. Case No. 08 of 2022 pending in the Court of learned J.M.F.C. (City), Cuttack for the commission of the alleged offence punishable under section 52(a)(i) of Odisha Excise Act.

Learned counsel for the State on instruction submitted that the petitioner is not an accused in the case and he is having no criminal antecedent and he is

// 2 // the owner of the offending vehicle for which his negotiation is necessary. The instruction filed by the learned counsel for the State is taken on record. In view of such instruction received by the learned counsel for the State, since there is no apprehension of arrest of the petitioner in connection with this case, this anticipatory bail application is disposed of. However, the petitioner shall appear before the Investigating Officer on being noticed and cooperate with the investigation.
