This matter is taken up through hybrid mode.

Heard Mr. S.P. Mishra, learned Senior Advocate appearing along with Mr. S. Mishra, learned counsel for the petitioner; and Mr. P.P. Mohanty, learned Addl. Govt. Advocate of the State. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to disburse/reimburse the pending dues of the petitioner to the tune of Rs.1,17,54,865/- incurred by him towards payment of enhanced minimum wages to labourers, cost of materials and Petroleum Oil and Lubricants inter alia, in terms of Clauses 32 and 33 of the Agreement vide Annexure-2, as well as in terms of Office Memorandum dated 19.11.2019 of the Works Department, Government of Odisha and Office Memorandum dated 07.06.2021 of the said Department along with interest. 4.

Since the petitioner submitted price escalation bill in terms of Clauses 32 and 33 of the agreement and the same was returned by the authority to the petitioner to provide further documents along with claim made by him, which is still pending, this Court is not inclined to entertain this writ petition. However, liberty is granted to the petitioner to pursue his remedy before the

appropriate forum in terms of the detail tender call notice or as per the agreement executed between the parties in accordance with law.

With the aforesaid liberty, the writ petition stands disposed of.
