This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.09 of 2020, on the files of learned Sessions Judge Rayagada, arising out of Gunupur P.S.

Case No.17 of 2019, under Sections 147/148/450/325/302/201/506/149 of IPC read with Section 4(!) of the Odisha Prevention of Witch Hunting Act.

Taking into account the nature of allegations this Court is not inclined to entertain this BLAPL application. Accordingly the same stands rejected.

Since the petitioner is in custody since 29.02.2019 the learned Court in seisin of the matter may expedite the trial and conclude the proceeding within a period of four months from the date of receipt/production of the copy of this order. It shall be open to the

petitioner to renew his prayer if the trial is not concluded within the time stipulated and the delay is not attributable to him. (V. NARASINGH) Judge Santoshi
