Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 25.01.2022 being remanded in connection with Raikia P.S. Case No.04 of 2020 corresponding to C.T. Case No.05 of 2022 pending in the Court of learned Special Judge-cum-Addl. District and Sessions Judge, Balliguda for the alleged commission of offence under Sections 279/337/338/307 of IPC read with Section 20(b)(ii)(C) of NDPS Act. 4.

It appears that no contraband was seized from the exclusive and conscious possession of the petitioner and he was implicated in the case on the basis of the statement of the co-accused persons to the effect that they had procured the contraband from the petitioner.

Having regard to the fact that nothing was seized from the possession of the petitioner, I am inclined to allow the prayer for

bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
