Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 06.07.2021 in connection with Koksara P.S. Case No.129 of 2021 corresponding to C.T. Case No.70 of 2021 pending in the Court of learned Addl. Sessions Judge, Dharamgarh for the alleged commission of offence under Section 376(2)(n) of IPC.

The allegation against the petitioner is that he had taken the victim to his friend, Jaya Kaibarta, who was supposed to marry her and since the said Jaya Kaibarta did not come forward to marry, the petitioner took her to Andhra Pradesh, where they started residing as husband and wife.

Having regard to the fact that the victim being a major lady, had willfully gone with the petitioner and taking into consideration the period of detention in custody as also the fact that charge sheet
has already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
