This CMP arose out of an order involving disposal of Order 39 rule 3 of C.P.C. application in the pendency of Order 39 rule 1 & 2 of C.P.C. application. By production of record, it has been brought to the notice of the Court by Mr.Mohanty, learned Senior Counsel that following the further direction in entertainment of the CMP dated 07.03.2022, the trial court in the meantime has already come to dispose of the application under Order 39 rule 1 & 2 of C.P.C. finally. In the circumstance this Court finds, there is no cause of action surviving to be undertaken in the present CMP which is disposed of accordingly. (Biswanath Rath) Judge S.P. Dash
