Fundamental application already involved disposed of in the impugned order is not filed in the Civil Miscellaneous Petition while challenging such order. In the circumstance, this Court finds the Civil Miscellaneous Petition is defective. Petitioner is permitted to withdraw the Civil Miscellaneous Petition to file better application. 3.

The Civil Miscellaneous Petition stands disposed of with the observation made hereinabove.

On oral submission of learned counsel for the petitioner, certified copy of the impugned order be returned on substitution of xerox copy thereof.
