This matter is taken up through hybrid arrangement Order No.
(virtual/physical mode).

Learned counsel for the Petitioner files the copy of the order passed by this Court on 18.02.2022 in BLAPL No.11242 of 2021, which is taken on record.

This is the second journey of the petitioner, who is in custody in connection with Khurda Model P.S. Case No.232 of 2020 corresponding to T.R. Case No.34 of 2020 pending in the court of the learned 2nd Additional Sessions Judge-cum-Special Judge, Khurda running for the alleged commission of offence under sections 21(C) & 29 of the N.D.P.S. Act & section 25(1)(a) of the Arms Act in filing this application under section 439, Cr.P.C. for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made and on going through the materials placed on record especially giving a reading to the order passed by this Court in BLAPL No.11242 of 2021; while being inclined to reconsider the prayer for grant of bail to the Petitioner in the aforesaid case, it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further condition that he will appear in person before the Court in seisin of the case on each date of posting of the case till conclusion of trial; will not indulge himself in similar type of activity and will not leave the jurisdiction of the Court in seisin of the case without prior permission of the court.

The BLAPL is accordingly disposed of.
