This matter is taken up through hybrid mode.

The Petitioner in this RPFAM seeks to assail the order dated 31st January, 2020 passed by learned J.M.F.C., Khallikote, under M.C. No. 70 of 2017 in an application under Section 125 Cr.P.C. 3.
In course of hearing, Mr. Mohanty, learned counsel for the Petitioner prays for withdrawal of this RPFAM to avail the remedy by filing a revision before learned Sessions Court. 4.
In view of such submission made by learned counsel for the Petitioner, the RPFAM is disposed of as withdrawn. 5.
Certified copy of the impugned order shall be returned to learned counsel for the Petitioner on substitution of photocopy thereof. 6.
It is observed that if a revision is filed within a period of two weeks hence, along with the petition for condonation of delay, learned Revisional Court shall construe the delay liberally taking into consideration, the pendency of this RPFAM before this court since 19th February, 2020 till date.
