Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Jagatpur P.S. Case No.78 of 2021 corresponding to G.R. Case No.435 of 2021 pending in the Court of learned J.M.F.C. (R), Cuttack for alleged commission of offences under sections 379, 411, 120-B/ 34 of the Indian Penal Code. Perused the F.I.R. annexed to the anticipatory bail application.
Considering the submission made by the learned counsel for the petitioner that there is no such material to
// 2 // attract the ingredients of the offences under which the case has been registered and the fact that the offences are triable by Magistrate and on hearing the learned counsel for the State, who submitted on instruction that there are no criminal antecedents against the petitioner, the interim order dated 17.03.2021 is made absolute.
The ABLAPL is accordingly disposed of.
Issue urgent certified copy as per Rules.
