This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with O.R. Case No. 193 of 2021-22 corresponding to 2(b) C.C. Case No. 01 of 2022 pending in the Court of learned J.M.F.C., Panposh (Rural), Rourkela for the commission of the alleged offences punishable under sections 56 of Orissa Forest Act, 1972 read with Rule 21 of the Orissa Timber and other Forest Transit Rules.

Perused the first information report annexed to

// 2 // the anticipatory bail application.

Learned counsel for the State on instruction submitted that in connection with this case, some of the co-accused persons were taken into custody and the petitioner's implication is based on the confessional statement of the co-accused persons and those co-accused persons have already been released on bail.

Considering the submissions made by the learned counsel for the respective parties, while not inclining to release the petitioner on anticipatory bail, it is observed that in the event the petitioner surrenders and moves for bail in the Court below within a period of four weeks from today, the learned Courts below shall dispose of the same in accordance with law expeditiously and the claim of parity with the co-accused persons who are stated to have been released on bail, shall be taken into account. The case records shall be made available to the Courts concerned for disposal of the bail application. The ABLAPL stands disposed of.

Issue urgent certified copy as per Rules.
