Undisputedly revision lies involving the rejection of an application under Order 7 rule 11 of the Code of Civil Procedure. In the circumstance, learned counsel appearing for the petitioner prays for withdrawal of the Civil Miscellaneous Petitioner with liberty to the petitioner to file revision. Consequently, the Civil Miscellaneous Petition stands dismissed as withdrawn but, however, with liberty as prayed for.
