This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Jagatsinghpur P.S. Case No. 100 of 2022 corresponding to G.R. Case No.249 of 2022 pending in the Court of learned S.D.J.M., Jagatsinghpur for the commission of the alleged offences punishable under sections 147, 148, 353, 455, 294, 427, 323, 354, 171-C, 120-B, 149 of the Indian Penal Code read with section 29 of the O.G.P. Act, section 135 and 135-A of the Representation of

Learned counsel for the State on instruction submitted that it is a case of booth capturing and the petitioner has got one criminal antecedent and the accusation against the petitioner is that he caused hindrance to the public servants while they were performing their duties at the time of election. In view of such materials available on record and the nature and gravity of accusation, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders and moves for bail before the Court below within a period of four weeks from today, the learned Courts below shall dispose of the same expeditiously in accordance with law. The case records shall be made available to the Court concerned for disposal of the bail application.

The ABLAPL stands disposed of.
