This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Chandrasekharpur P.S. Case No.97 of 2021 corresponding to C.T. Case No.1052 of 2021 pending in the Court of learned S.D.J.M., Bhubaneswar for alleged commission of offence under section 394 of the Indian Penal Code.

Perused the F.I.R. annexed to the anticipatory bail application.

Taking into account the background of the case

// 2 // and the surrounding circumstances under which the offence is alleged to have taken place and the fact that there is no criminal antecedent against the petitioner and the offence is triable by Magistrate and on hearing the learned counsel for the State, the interim order dated 17.03.2021 is made absolute. The ABLAPL is accordingly disposed of.
