This matter is taken up through video conferencing mode. 2.

Heard Mr. D. Mohapatra, learned counsel for the petitioner, Mr. D.K. Mohanty, learned Additional Standing Counsel and Mr. S.K. Mishra, learned counsel, who usually appears for Odisha State Civil Supplies Corporation. 3.

According to Mr. Mohapatra, the petitioner is aggrieved by the order passed by the Collector, Khurda on 01.02.2022 under Annexure-12 disengaging the petitioner from paddy procurement operation for KMS 2021-22 on the basis of joint enquiry report, a copy of which was never supplied to the petitioner. He also submits that the petitioner has been participating in paddy procurement for custom milling since last 15 years and has always been successfully delivering the CMR. This year on account of untimely rain, a group of people congregated and started demonstration in front of the rice mill

// 2 // on 22.01.2022 resisting transportation demanding that irrespective of quality, all paddy should be procured notwithstanding the damaged suffered on account of such rain. All these adversely affected paddy procurement operation for no fault of the petitioner. He further submits that though highlighting all its grievances, the petitioner has approached the Managing Director, Odisha State Civil Supplies Corporation on 14.02.2022 by filing a representation under Annexure-16 however, till date nothing has been done in the matter. In such background, he prays that that a direction be issued to the Managing Director, Odisha State Civil Supplies Corporation to take a decision on the above noted representation within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Managing Director, Odisha State Civil Supplies Corporation to take a decision on the above noted representation of the petitioner under Annexure-16 in accordance with law within a period of seven days from the date of receipt of a certified copy of this order and communicate the result of such exercise to the petitioner forthwith. 5.

Accordingly, this writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application in course of the day.
