This matter is taken up through Hybrid mode.

The grievance of the Petitioner in this writ petition is that though his vehicle bearing registration number OD-19-A6940 (Tipper) has been illegally seized by the Tahasildar, Chendipada, Opposite Party No.2, but the seizure list has not been provided to him after seizure of the said vehicle nor any paper relating the seizure has been supplied to him for commission of any illegality by using the said Tipper and as such a direction may be issued to the Tahasildar, Chendipada to release the vehicle in his favour.

It appears that in spite of the opportunity given to the learned counsel for the State to obtain instruction from the Tahasildar, Chendipada in this matter, though this writ petition is pending since 2020, no instruction has been obtained.

// 2 // Learned counsel for the State has sought for an adjournment to obtain the instruction, but I am not inclined to adjourn the matter further.

Considering the facts and the submissions made, this Court disposes of the writ petition with a direction to the Tahasildar, Chendipada, Opposite Party No.2, to release the vehicle of the Petitioner bearing registration number OD-19-A6940 (Tipper), if the same has not been seized in connection with any case and if it has been seized in connection with the aforesaid case provides the entire copies of the proceedings to the Petitioner forthwith on the date of receipt of a certified copy of this order. Failure to comply with the same shall expose the Tahasildar, Chendipada to the contempt jurisdiction of the Court.

Urgent certified copy of this order be granted on proper application 6.

Free copy of this order be supplied to the learned counsel for the State.
