IN THE HIGH COURT OF ORISSA AT CUTTACK

ABLAPL No.2398 of 2022 Satish Tameswarnath Choudhury ....

Petitioner Mr.R.N. Singh, Advocate -versusState of Odisha & another ....

Opp. Parties Mr. D.K. Pani, Addl. Standing Counsel

CORAM:

JUSTICE S.K. SAHOO Order No.

ORDER

23.03.2022 01.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Berhampur GRPS Case No.36 of 2013 corresponding to G.R. Case No. 1139 of 2013 pending in the Court of learned S.D.J.M., Berhampur for the commission of the alleged offences punishable under sections 366-A/34 of the Indian Penal Code, section 3 of the S.C. & S.T. (PoA) Act, section 14 of Child Labour (P & R) Act and section 23 of Juvenile Justice (Care and Protection of Children) Act and section 3 of the S.C. & S.T. (PoA) Act.

// 2 // Perused the first information report annexed to the anticipatory bail application.

This is the third successive application of the petitioner before this Court for grant of anticipatory bail. In the cause title, no reference of earlier filing of anticipatory bail application has been mentioned, which is a suppression of fact. Moreover, the case is of the year 2013. Therefore, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail stands rejected. The ABLAPL stands dismissed.
