Heard learned counsel appearing for the parties. Order No.

Despite alternative and efficacious remedy available to pursue the remedy of re-counting by way of appropriate application to the competent authority, learned counsel appearing for the petitioners is arguing the matter to justify his claim by showing a decision of this Court. Undisputedly there is declaration of result involving the election. 3.

In the circumstance and after the publication of result, the writ petition per se is not entertainable. Consequently, the writ petition stands dismissed. It is open to the petitioners to apply such decision to their case in the event of appropriate remedy. (Biswanath Rath) Judge Sks
