BLAPL No. 2017 of 2022 Aji @ Ajit Sahoo @ Aji Kumar Sahoo ....
Petitioner Mr. A.P. Bose, Advocate - Versus - State of Odisha ....
Opposite Party Mr. P. Tripathy, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
05.05.2022 1.
This matter is taken up through hybrid mode.
Order No.
2.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
The Petitioner is in custody since 17th January, 2022 in connection with Rasol P.S. Case No.09/2022 corresponding to G.R. Case No.27/2022 pending in the court of learned S.D.J.M., Hindol for the alleged commission of the offence under Sections 450/395/397/201/120-B of I.P.C.
4.
Though the allegation is that the Petitioner committed dacoity in a Bank and looted gold ornaments and cash more than Rs.12 lakhs, yet from the materials on record, it appears that the Petitioner was not part of the gang that committed the dacoity and that he was a tea-stall owner near the Bank who had closed down his stall at the instance of the co-accused persons. 5.
Considering the above facts as also the period of detention of the Petitioner in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the
aforesaid case including the following conditions:- (i) he shall appear before the court in seisin over the matter on each date of posting of the case and in case of even a single default, necessary orders shall be passed by the said Court to take him to custody again; and (ii) he shall also appear before the I.I.C. of Rasol P.S. once every Monday at 10 A.M. for a period of six months and such fact shall be certified by the I.I.C. to the court below once every month.
6. The BLAPL is disposed of accordingly.
7. Issue urgent certified copy as per rules. (Sashikanta Mishra) Judge A.K. Rana
