This matter is taken up through hybrid arrangement (virtual/physical mode).

Learned counsel for the Petitioner submits that the Petitioner after expiry of interim bail has already surrendered before the court below.

This is the second journey of this petitioner, who is in custody in connection with Sambalpur Northern Division EI & EB Unit-II, Excise P.R. No.63/2018-19 corresponding to 2(a)C.C. Case No.3 of 2018 pending in the Court of the learned Sessions Judgecum-Special Judge, Sundergarh for offence punishable under sections 20(b)(ii)(C) of the NDPS Act in filing this application under section 439, Cr.P.C. for his release on bail.

Upon hearing the learned counsel for the petitioner and learned counsel for the State and on going through the materials available on record as also the surrounding circumstances, finding no such change in the circumstance, while being not inclined to reconsider the prayer for grant of bail to the Petitioner, this application stands disposed of with the observation that the trial court would do well to take all effective steps as provided in law for

// 2 // conclusion of trial as expeditiously as possible, preferably within a period of two months hence.

The BLAPL is accordingly dismissed.
