RJ The writ petition has been filed by the petitioner who is at present working as Assistant Teacher (Trained Graduate Teacher Arts) in Balda Govt. High School (SSD), Balda in the district of Koraput for regularization of her service w.e.f. 12.11.2009 on completion of six years of service taking into account the date of her joining as Sikshya Sahayak as on 12.11.2003 with all consequential service and financial benefits by way of modification of the order of regularization dated 20.09.2011 (Annexure-6) issued by the Collector, Koraput.

The matter is heard at length regarding the applicability of the resolution dated 10.01.2008 (Annexure-4), Govt. of Odisha, Department of School and Mass Education Department to the service of the petitioner.

A prayer is made by the petitioner to withdraw the writ petition to move the appropriate authority for redressal of her grievances in accordance with law.

This Court expresses no opinion on the contentions regarding applicability of the resolution dated 10.01.2008 (Annexure-4) to the service of the petitioner.

// 2 // It is further submitted by the learned counsel for the petitioner that the petitioner has made representation marked as Anneuxre-11 dated 29.01.2022 which is pending consideration.

In response, learned Addl. Standing Counsel submits that the representation, if any shall be considered in accordance with law and disposed of in due time. It is further submitted that since the representation was made very recently i.e. on 29.01.2022, the authorities may be granted some further time to deal with the issue.

Accordingly, the writ petition is disposed of observing that the authority shall consider the representation as at Annexure-11, if pending within a period of four months from the date of communication of the certified copy of this order along with photocopy of Annexure-11 and all relevant documents sought to be relied upon the by the petitioner. It is clarified that this Court has not expressed any opinion regarding merits of the case, in any manner whatsoever.

Issue urgent certified copy as per rules.
