1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

3. The petitioner has been arrested in connection with Gosaninuagaon P.S. Case No. 168 of 2021 corresponding to G.R. Case No. 2129 of 2021 pending in the court of learned S.D.J.M., Berhampur for the alleged commission of offence under Sections 341/294/307/324/506 of IPC read with Section 25(1-B)(a) and 27 of Arms Act, 1959.

The allegation against the petitioner is that he opened fire on the injured victim in broad day light from his gun causing injury which is simple in nature, yet having regard to the circumstances in which the crime was committed, the nature of accusations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore rejected. It is however open to the petitioner to renew his prayer after commitment of the case to the Court of sessions for trial.

6. The BLAPL is accordingly rejected.
