Heard Mr. N. Jujharsingh, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Additional Government Advocate.

The petitioner has filed this writ petition seeking direction to make payment of dues towards the maintenance work for the 3rd year for an amount of Rs.14,52,162/- arising out of Agreement No. 02 N.C.B./Ph.-VIII of 2009-10 for the work, "Improvement to Road & C.D. Works under PMGSY Phase-VIII road works during 2008-09 for the Package No.-OR-09-74/VIII in the District of Dhenkanal" as per the letter no.927 dated 15.03.2018

of the Executive Engineer, Rural Works Division, Dhenkanal.

At the outset, it appears that the petitioner makes money claim as accrued pursuant to letter dated 15.03.2018 issued by the Executive Engineer, Rural Works Division, Dhenkanal. In the meantime, three years have been elapsed. Therefore, this Court is not inclined to entertain the writ petition. However, petitioner is at liberty to pursue its remedy before the appropriate forum in accordance with law.

The writ petition stands disposed of granting liberty as aforesaid.
