Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 21.02.2022 in connection with Kantamala P.S. Case No.153 of 2019 corresponding to Special (NDPS) Case No. 126 of 2019 pending in the court of learned District and Sessions Judge-cum-Special Judge, Kantamal for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

As per the prosecution story, the petitioner is the owner of the vehicle in which the contraband was said to have been transported and there is no material on record to show that the said transportation was being done at the instance of the petitioner. 5.
Having regard to the above, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and
conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
