Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 16.01.2022 in connection with Laxmipur P.S. Case No.07 of 2022 corresponding to G.R. Case No.17 of 2022 pending in the court of J.M.F.C., Laxmipur for the alleged commission of offence under Sections 457/380 of IPC. 4.

As it appears, the stolen gold ornaments have been recovered, as evident from the statement of the accused as also the seizure list filed by the learned counsel for the petitioner in Court today. 5.

Having regard to the above, the period of detention in custody and the fact that the stolen articles have been recovered, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition

that he shall personally appear before the trial Court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
