This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Dhamanagar P.S. Case No. 117 of 2021 corresponding to G.R. Case No.196 of 2021 pending in the Court of learned J.M.F.C., Dhamnagar for the commission of the alleged offences punishable under sections 341, 323, 427, 307, 379, 506, 34 of the Indian Penal Code.

Perused the F.I.R. annexed to the anticipatory bail application.

Learned counsel for the petitioner submitted

// 2 // that the petitioner's implication in the case is based on the confessional statement of co-accused Chandan Kar and the said co-accused has already been taken into custody and he has been released on bail and therefore, the anticipatory bail application of the petitioner may be favourably considered.

Learned counsel for the State opposed the prayer for bail.

Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioner, while not inclining to release the petitioner on anticipatory bail, it is ordered that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be considered in accordance with law expeditiously and while disposing of the bail application, the learned Courts below shall consider the claim of parity with the co-accused person, who is stated to have been released on bail. The case records shall be made available to the Court concerned.

The ABLAPL stands disposed of.
