1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

3. The petitioner is in custody since 18.01.2022 in connection with Kakatpur P.S. Case No.215 of 2020 corresponding to G.R. Case No.69 of 2021 pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Nimapara for the alleged commission of offence under Sections 21(c)/29 of the NDPS Act.

4. As it appears, nothing was seized from the possession of the petitioner and basing on the statement of the co-accused he has been implicated in the case. The allegation is that he was the proposed buyer of the contraband which was seized from the possession of one Mir Rahat Ali. It further appears that one Mangu @ Mangaraj Mohanty, who stands on the same footing as the present petitioner has already been granted bail by this Court in

BLAPL No. 9007 of 2020.

5. Considering the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

6. The BLAPL is accordingly disposed of.

7. Urgent certified copy of this order be granted on proper application.
