Taking this Court to the additional prayer more particularly prayer no.c, Mr.Panigrahi, learned counsel for the petitioner requests this Court for at least direction for finality of the application under Order 39, rule 1 & 2 of the Code of Civil Procedure. Mr.Panigrahi, learned counsel for the petitioner brings to the notice of this Court that there is filing of objection by the petitioner and the application under Order 39, rule 1 & 2 is ready for final hearing otherwise. 3.

Considering the urgency involved and as the petitioner is affected by interim order already there, in the event there is already filing of objecting to the application under Order 39, rule 1 & 2 of the Code of Civil Procedure and such application is otherwise ready for hearing, this Court in disposal of the Civil Miscellaneous Petition directs the Civil Judge (Senior Division), Bhubaneswar to dispose of the I.A.No. 1 of 2021 arising out of Civil Suit No.1795 of 2021 on the date of posting or at least within a period of ten days from the next date of posting.
