This matter is taken up through hybrid arrangement (virtual/physical mode).

This is the second journey of these petitioners in carrying this application under section 438, Cr.P.C. for their release on bail in the event of their arrest in connection with Odagaon P.S. Case No.91 of 2021 corresponding to G.R. No.176 of 2021 pending in the court of the learned J.M.F.C., Odagaon for alleged commission of offence under sections 294/341/324/307/392/34, I.P.C. 3.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions and viewing the materials on record as also other surrounding circumstances, while being not inclined to grant of anticipatory bail to these petitioners, while being not inclined to reconsider the prayer for grant of anticipatory bail to the Petitioners; this application is disposed of with the observation that in the event the petitioners surrender before the

// 2 // court in seisin of the aforesaid case and move for their release on bail, the same shall be considered on its own merit without being prejudiced by this order; further taking into account all such subsequent developments which have taken place in the meantime, in their proper prospective and disposed of early in accordance with law.

The ABLAPL is accordingly disposed of.
