Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 101 of 2018 corresponding to S.T. Case No. 111 of 2018 arising out of Bhanjanagar P.S. Case No. 62 of 2018 on the file of learned Additional Sessions Judge, Bhanjanagar, registered for the alleged commission of offence under Section 302 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judge, Bhanjanagar, by order dated 12.01.2021, the present BLAPL has been filed.

Perused the Case Diary and the statement of the witnesses.

Considering the manner in which the alleged offence is stated to have been committed and the basis of the implication and

taking note of the submission of the learned counsel for the petitioner that he has two minor children, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter so as to ensure his presence on each date of trial.

Accordingly, the BLAPL stands disposed of.
