This matter is taken up through hybrid mode.

This writ petition has been filed for a direction for early disposal of C.P. No. 486 of 2018 pending before learned Judge, Family Court, Cuttack.

Mr. Dalai, learned counsel for the Petitioner submits that pleadings of the parties in C.P. No. 486 of 2018 are complete. Conciliation having failed, the matter has been posted for hearing. Although there is no legal impediment to proceed with the matter and dispose of the same at an early date, learned Judge, Family Court, Cuttack is not making any endeavour in that regard. Hence, this writ petition has been filed for the aforesaid relief. 4.

Taking into consideration the submission made by learned counsel for the Petitioner and on perusal of the record, it is not clear as to the stage of the proceeding in C.P. No. 486 of 2018 pending before learned Judge, Family Court, Cuttack. This Court is also not appraised of pendency of such nature of cases before learned Judge, Family Court, Cuttack.

In view of the above, this Court is not in a position to consider the prayer made by learned counsel for the Petitioner. 6.

This writ petition is, therefore, disposed of with an observation that in the event the Petitioner files an application for early disposal of C.P. No. 486 of 2018 stated to be pending before learned Judge, Family Court, Cuttack stating the grounds therein within a period of two weeks hence along with certified copy of this order, he shall do well to consider the same in accordance with law and proceed with the matter accordingly.

Urgent certified copy of this order be granted on proper application.
