This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Government Advocate.

The Petitioner has filed this writ petition with the following prayer:

"It is therefore prayed that the Writ Petition be admitted, relevant records be called for and after hearing the counsel for the parties this Hon'ble Court be pleased to allow the writ petition.

And direct the Opposite Parties specifically the Opposite Party No.3 to send the Petitioner's service book to the B.D.O., Kashipur within a stipulated period.

And/or pass any other order/direction as deem just and proper by this Hon'ble Court."

It is submitted by the learned counsel for the Petitioner that the Block Development Officer, Opposite Party No.3 has not forwarded

// 2 // the Service Book of the Petitioner. Therefore, the petitioner is not getting his pensionary and retiral dues. In such view of the matter, learned counsel for the Petitioner submits that the Petitioner has submitted a representation highlighting his grievance before Opposite Party Nos. 2 & 3 under Annexure-4 series and seeks for a direction to consider the representation of the Petitioner and dispose of the same within a stipulated period of time with a specific direction to Opposite Party no.3 to forward the Service Book to appropriate authority for sanction.

Learned Additional Government Advocate submits that he has no objection if the aforesaid prayer of the Petitioner is allowed. 6.

Considering the limited nature of grievance of the Petitioner the present writ application is disposed of at the stage of admission with a specific direction to Opposite party No.3 to immediately forward the Service Book of the Petitioner to the authority concerned within a period of two weeks from the date of production of certified copy of this order. Further the authorities are directed to consider the representation under Annexure-4 series and shall pass necessary orders in accordance with law within a period of one month from the date of production of certified copy of this order. The decision so taken on the representation of the Petitioner shall be communicated to the Petitioner immediately. If there is no other impediment, the claim of the Petitioner shall be processed as soon as possible and the Petitioner shall be paid the dues as admissible to him under law. With the aforesaid observation the writ application stands disposed of.

Issue urgent certified copy as per Rules.
